The family migration provisions of the Immigration Rules are complex, difficult to understand and can be a challenging exercise for the lay person. A UK Spouse Visa will permit you or your partner to live in the UK for 30 months. If you are seeking permanent residence for your Wife or Husband, then the Spouse Visa is the first step toward permanent settlement status in the UK. Generally, a UK Spouse Visa would lead on to a person applying for Indefinite Leave to Remain and then on to full British Citizenship.

The basic requirements for obtaining a Spouse Visa are that the relationship is genuine (proof of marriage is required) and that the sponsoring partner commands an income of at least £18,600 per year.

Non-EU citizens may apply for a UK Spouse Visa if they are already married to a UK citizen, UK refugee or a person with ‘settled status’ in the UK.

A Spouse Visa (Marriage Visa) is pertinent to homosexual and heterosexual marriages and provides the same rights as a Civil Partnership Visa

You can apply for a Spouse Visa for the UK from any country of residence around the world, or the application can be made here in the UK. There are stringent requirements that must be met for any application to prove successful.

You will need to provide official documentation to validate your relationship. If you have been living outside of the UK, but with your spouse (who is a British Citizen) in another EU country, you could seek entry to the UK under EU regulations. If successful, this route permits for a 5-year residents’ card if applying in the UK, or a 6-month permit if applying from outside the UK.

The minimum requirements for a UK Spouse Visa are largely the same for any type of UK Partner Visa.

UK Spouse Visa requirements involve:

  • Proof of English Language ability
  • Passing the genuine relationship test
  • Evidence of having proper accommodation in place
  • A minimum sponsor partner income of £18,600 per year.

If dependent children are part of the family unit then the minimum income threshold is subject to increase. This threshold is raised to £22,400 per year if there is one dependent child and is subject to incremental rises of £2,400 for every additional child.

The UK Home Office charges different rates for a UK Spouse Visa depending on if you are applying with dependent children as well.

It is also worth noting that since Aug 2017 decision on Spouse Visa application success pertaining to the income threshold must seek to consider alternative financing other than a regular salary. Considerations such as being able to financially sustain yourself without a job, whether you are planning to be self-employed or whether continued support (financially) may be provided by other family members.

In the unlikely event your UK Spouse Visa application is refused, it is normal for you to be issued with a right to appeal the decision if you feel the application refusal is unfair. We would point out that if you are already in the UK when a refusal of such an application occurs then it is crucial that you act quickly and without hesitation. You must either contest the refusal or apply for another UK immigration Visa at once.  Overstretching the permitted duration of stay you have been granted, can be hugely detrimental to your long-term settlement plans.

Secure English Language Tests that have been assessed as meeting the Home Office’s requirements from 1 August 2014 can be used in a UK immigration application until 5th November 2015, only when they have been taken on or before 5th April 2015. From 6th April 2015 there is a new list of approved Secure English Language Tests and Test Centres.  Anyone taking a test on or after 6th April 2015 must take one of the new listed tests at one of the approved centres if they wish to use it in a UK Immigration application, unless you have a certificate that has previously been accepted by the Home Office as part of a successful application.
You may also need to pay a healthcare surcharge called the ‘immigration health surcharge’ as part of your immigration application.
