Spouse Visa and Family Visas
If you are British Citizen or have settled status and have family members abroad, they will need to apply for entry clearance in order to join you in the United Kingdom. Over the years, the Home Office has introduced stringent criteria that you will need to meet in order to submit a successful application. There are now numerous requirements and specified evidence required that must be submitted. Many applications are refused because the applicant has not provided all of the evidence required.
Our highly experienced immigration lawyers will be able to clarify any parts of the visa application that are unclear, and advise you on your eligibility and how you can prove your status to the authorities.
UK Spouse Visa Immigration Help & Advice
The family migration provisions of the Immigration Rules are complex, difficult to understand and can be a challenging exercise for the lay person. We have a wealth of experience in advising clients on meeting the Minimum Income Requirement of Appendix FM and the related evidential requirements under Appendix FM-SE. We are on hand to help you calculate the gross annual income for employees and self-employed people and the sum required if an applicant is relying on savings to supplement any shortfall. We advise on the minimum income threshold of £18600.00. We can also provide practical guidance on the content of these provisions and ways to challenge decisions by ECOs and the SSHD.
The basic requirements for obtaining a Spouse Visa are that the relationship is genuine (proof of marriage is required) and that the sponsoring partner commands an income of at least £18,600 per year.
Non-EU citizens may apply for a UK Spouse Visa if they are already married to a UK citizen, UK refugee or a person with ‘settled status’ in the UK.

If you have been living outside of the UK, but with your spouse (who is a British Citizen) in another EU country, you could seek entry to the UK under EU regulations. If successful, this route permits for a 5-year residents’ card if applying in the UK, or a 6-month permit if applying from outside the UK.
UK Spouse Visa requirements involve:
- Proof of English Language ability
- Passing the genuine relationship test
- Evidence of having proper accommodation in place
- A minimum sponsor partner income of £18,600 per year.
If dependent children are part of the family unit then the minimum income threshold is subject to increase. This threshold is raised to £22,400 per year if there is one dependent child and is subject to incremental rises of £2,400 for every additional child.
The UK Home Office charges different rates for a UK Spouse Visa depending on if you are applying with dependent children as well.
It is also worth noting that since Aug 2017 decision on Spouse Visa application success pertaining to the income threshold must seek to consider alternative financing other than a regular salary. Considerations such as being able to financially sustain yourself without a job, whether you are planning to be self-employed or whether continued support (financially) may be provided by other family members.
Royce Legal are happy to help people who have had UK Spouse Visa refusal notices where you have sought support through the application process elsewhere.
We would point out that if you are already in the UK when a refusal of such an application occurs then it is crucial that you act quickly and without hesitation. You must either contest the refusal or apply for another UK immigration Visa at once. Overstretching the permitted duration of stay you have been granted, can be hugely detrimental to your long-term settlement plans.
